Kogi High Court Strikes Out Senator Dino Melaye’s Case

A Kogi State High Court sitting in Lokoja on Tuesday struck out the assassination case involving Alhaji Taofiq Isa the Administrator of Ijumu local government area and four others for want of diligent prosecution.

The police had charged Taofiq Isa and four others; Ade Obege, Abdullahi Isah, Michael Bamidele and Ahmed Ajayi to court over their alleged involvement in the assassination attempt on the life of Senator Dino Melaye at his Ayetoro Gbede country home on April 15, 2017.

But ruling on the matter, the trial judge, Justice Fola Ajayi explained that the prosecution could not open its case despite four adjournments to enable them to put their house in order.

He, therefore, struck out the case for lack of diligent prosecution and gave a consequential order that the prosecution could start their case afresh whenever they are ready.

Reacting, counsel to the defendant, Zakari Abbas commended the trial judge for what he described as “landmark judgement”.

He said the judge having listened to all parties and convinced that the petitioners were unwilling to present their witnesses, came to the conclusion that the prosecution has not diligently pursued its case.

“Hence the charge brought against the defendants have been struck out. As it stands there are no criminal charges against the defendants.

“However, the judge gave a consequential order that whenever they are ready with their witnesses, they could approach the court to start their case afresh”, he said.

Also reacting to the ruling, Alhaji Taofiq Isa expressed joy and described the judgement as “an act of God”, saying that the judiciary still remains the hope of the common man.

He said he has forgiven those who had accused him wrongly and called on all Okun sons and daughters to come together in the interest of the development of the area.
