DAILY SUN NEWSPAPER: Stop Fabricating Stories Against Lawyers On Abia Politics — Ugochukwu Amaraizu Esq.

Daily Sun Newspaper of Friday- 29th July, 2016 has a brief article on page 10 thereof with the caption ” ABIA GUBER CRISIS: CONTROVERSY TRAILS APPEAL COURT JUDGMENT….” According to the report:

“Some lawyers have argued that the judgment by the appellate court sitting in Abuja had created more confusion since no stay of execution order was issued….” This very assertion as reported by DAILY SUN is not credited to any lawyer in the said article. While Daily Sun specifically mentioned the name of Kevin Godwin Abonyi of Oseloka Osigwe Chambers- Nnewi, Anambra State as the the lawyer who spoke in favor of the Court of Appeal stand on status quo, they continued to project a position not championed by any lawyer in the entire federation.

As can be gleaned from the page 10 of the newspaper, Daily Sun, without mentioning the name of any lawyer, reported that ” Lawyers against the judgment, however, maintained that Ikpeazu was governing Abia State without a valid Certificate of Return and insisted that Ogah must be sworn in since there was no stay of execution order issued by the appellate Court….”

In view of the Court of Appeal’s decision early this week, which is in consonance with the Supreme Court’s decision in Mohammed Vs Olanwunmi, no lawyer will proceed to canvas such argument on the pages of newspaper. No lawyer will call for Ogah’s swearing in against an existing Order of a High Court which is yet to be vacated. Secondly, no lawyer will call for Ogah’s swearing in against the decision of the Court of Appeal which stated that parties should maintain status quo. No lawyer will even call for Ogah’s swearing in with the present Certificate of Return that bears a date obviously known to have been issued in error as the date contained therein never produced a Governor in Abia State. Finally, no lawyer will call for Ogah’s swearing in when the Federal High Court itself never issued an Order that Ogah should be sworn in. They better go back and read Justice Abang’s judgment.

If Daily Sun insists that lawyers canvassed such an argument, they should disclose the names of the said lawyers.
